By accessing and using our website, www.kyono.ch (the "Site"), or purchasing products from us, you agree to the following terms and conditions ("Terms"). Please read them carefully.
1. Scope
1.1 These Terms, along with our Privacy Policy and Return Policy, govern your use of the Site, including any transactions or subscriptions for products and services offered by Kyono GmbH (referred to as "Kyono," "we," "us," or "our"). By accessing the Site or purchasing products, you acknowledge that you have read, understood, and agreed to these Terms.
1.2 These Terms apply only to purchases made directly through the Site. If you purchase Kyono products through authorized distributors or retailers, their respective terms will apply.
1.3 We may update these Terms from time to time. Please review them regularly to stay informed about any changes.
1.4 If you do not agree to these Terms, you must discontinue use of the Site and refrain from purchasing our products.

3. The Product
3.1 Our products include personalized supplements and health products for pets based on health data such as microbiome tests. Product descriptions, images, and ingredient lists on the Site are for informational purposes only and may differ slightly from the final product. The actual packaging and labeling provide the most accurate product details.
3.2 Products are subject to availability. If a product is out of stock after you place an order, we will notify you by email and issue a refund for the unavailable item.
3.3 Presales: Kyono may offer pre-sales for certain products. Delivery timelines for pre-sale items may extend up to 6 months or longer, depending on production and supply chain factors. If delays exceed the initial timeframe, we will notify you and provide options to continue with the order or receive a full refund.
3.4 Our products are intended for pet health and wellness. They are not substitutes for professional veterinary advice. Please consult your veterinarian before introducing new supplements to your pet's diet. Kyono does not provide medical advice or services
3.5 Liability Disclaimer: Kyono products and services are designed to monitor and support your pet’s health but are not intended to diagnose or treat medical conditions. Similar to human supplements, our tools and analyses are advisory in nature and not a replacement for veterinary care. In cases of clinical disease, we clearly state the need for veterinary support.
Kyono offers veterinary consultations through third-party providers. In such cases, liability rests with the third-party provider.
We explicitly clarify in user agreements and product disclaimers that Kyono is not liable for suboptimal recommendations, except as required by local consumer protection and negligence laws.
If necessary, we can provide referrals to certified veterinary nutritionists, further shifting liability to these professionals.
Kyono plans to carry professional liability insurance and implements rigorous quality control measures for our algorithms and recommendations to minimize risk.
4. Your Account and Personal Information
4.1 You may browse the Site without creating an account. However, to make purchases or manage subscriptions, you can choose to create an account for faster checkout and personalized recommendations.
4.2 By registering, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account details.
4.3 Personal information collected through account registration, purchases, or subscription sign-ups is processed in accordance with our Privacy Policy.
5. Buying Products from Us
5.1 You must be at least 16 years old to make purchases through the Site.
5.2 The display of products on our Site does not constitute a legally binding offer but serves as an invitation to place an order.
5.3 By placing an order, you commit to purchasing the selected products. After completing your order, you will receive a confirmation email acknowledging receipt of your request. This does not confirm acceptance of the order.
5.4 A contract between you and Kyono is formed when we dispatch the product and send you a shipping confirmation email.
5.5 If we cannot fulfill part or all of your order, we reserve the right to cancel it and issue a refund.
5.6 Subscriptions:
We offer subscription services for recurring deliveries of supplements or pet health products.
Subscriptions automatically renew for the same term unless canceled by the user at least 30 days before the next billing cycle.

6. Prices and Payment
6.1 All prices are displayed in Swiss Francs (CHF) and are exclusive of applicable taxes and shipping costs unless stated otherwise.
6.2 Prices are subject to change. If a pricing error occurs, we will contact you before processing your order to confirm the correct price or allow cancellation.
6.3 Payment methods will be provided at checkout. Currently, payment options are to be determined. Payment is required at the time of order placement.
7. Delivery and Shipping
7.1 Orders are processed and shipped by our partner labs and manufacturers. Estimated delivery times will be indicated during checkout.
7.2 Kyono is not responsible for delays caused by factors beyond our control (e.g., customs processing, supply chain disruptions).
7.3 For international orders, additional customs fees or taxes may apply. These charges are the responsibility of the customer.
8. Returns and Refunds
8.1 Returns and refunds are governed by our separate Return Policy. Please review this policy for details on eligible returns and the process for requesting refunds.
8.2 Due to the nature of personalized pet supplements, some products may not be eligible for return unless defective or damaged upon arrival.
9. Limitation of Liability
9.1 Kyono is not liable for any indirect, incidental, or consequential damages resulting from the use of our Site or products. Our liability is limited to the amount paid for the affected product.
9.2 We do not exclude liability for gross negligence, fraudulent misrepresentation, or personal injury caused by our products.
10. Governing Law and Jurisdiction
10.1 These Terms are governed by Swiss law. Any disputes will be subject to the exclusive jurisdiction of the courts in Zurich, Switzerland.
